Attorney Lynn M. Salvatore recently represented a Florida mother, Brooke, in an expedited termination of parental rights case as to her three young girls, P. M., R.R., and B. M.
In June of 2014, the Department of Children & Families, State of Florida, and the Child Protection Team, State of Florida, alleged that Brooke had intentionally caused numerous fractures in her then 7-week-old daughter. DCF removed all three children from Brooke’s custody and began legal proceedings to terminate Brooke’s parental rights. Brooke has since been diagnosed with Ehlers Danlos Syndrome, a connective tissue disorder that research shows increases the risks of fractures.
Attorney Salvatore and co-counsel mounted a yearlong defense, being forced to use medical experts outside the State of Florida. These medical experts were so convinced that the fractures were not the result of child abuse that they provided all services free of charge!
The three medical experts, a Illinois radiologist, a world renowned endocrinologist in Boston, and a long-time practicing California orthopedic surgeon testified that the child suffered fractures from normal day to day handling as a result of a temporary bone disorder, infantile rickets!
On September 21, 2015, the Chief Judge of the Fourth Judicial Circuit dismissed DCF’s case with prejudice and immediately returned the children to the mother’s custody! It goes without saying that Brooke and her family are over the moon.
